- the pages of our website, including descriptions of our services, how we work, where we work, and our guides
- our privacy notice, website terms of use and this manual, all on our website
As regulation 5 of the PAIA Regulations requires, we keep this list up to date and make it available on our website, at our office and to the Regulator. If you want a printed copy of one of these records, you pay only the reproduction fee in Annexure B of the PAIA Regulations.

If only part of a record is protected, we will release the rest.
8. How we process personal information

8.4 Planned transfers outside South Africa
Cloudflare processes information in many countries, including the United States. It is bound by data processing terms that protect personal information to a standard substantially similar to POPIA (section 72(1)(a) of POPIA).
We work in countries in Africa and Europe. When a client's service runs in another country, we send the people doing that work only the information the service needs, and only on a ground section 72 of POPIA allows, such as a binding agreement that protects it to a standard substantially similar to POPIA.
8.5 How we protect personal information
- Our website is served only over encrypted (HTTPS) connections, with strict browser security settings.
- Only the people who need personal information to do their work can see it.
- Our web developer, Cloudflare and our service providers may process personal information only on our instructions, and must keep it confidential and secure, as sections 20 and 21 of POPIA require.
- We keep personal information only as long as we need it or the law requires, and then delete or destroy it.
- If we believe personal information has been accessed without permission, we will tell the Regulator and the people affected, as section 22 of POPIA requires.
9. How to request access to a record
9.1 Your own personal information
You can ask whether we hold personal information about you, and ask for it, under section 23 of POPIA, without the PAIA request form. Our privacy notice explains your rights and how to use them.
9.2 Other records
- Complete Form 2 of the PAIA Regulations (Request for access to record). You can download it from the Regulator's PAIA forms page, or ask us for a copy.
- Send it to our Information Officer by email, at the address in section 3.
- Give enough detail for us to identify the record and you, say in what form you want access, and give a postal address or fax number in South Africa where we can reach you, and an email address if you have one.
- Say which right you want to use or protect, and explain why you need the record to do so (section 53 of PAIA).
- If you are asking on behalf of someone else, include proof that you may act for them.
If you cannot read or write, or have a disability that makes the form difficult, you may make your request orally. Our Information Officer will complete Form 2 for you and give you a copy (regulation 7 of the PAIA Regulations). Our Information Officer will also help you with any other part of your request.
9.3 Fees
The fees are set in Annexure B of the PAIA Regulations. For a private body like ours, they are:
| Item | Fee |
|---|---|
| Request fee, payable before we process the request (section 54(1) of PAIA). To ask for your own personal information, use section 9.1 instead | R140.00 |
| Photocopy or printed copy of an A4 page | R2.00 per page or part of a page |
| Copy on a flash drive you provide | R40.00 |
| Copy on a compact disc you provide | R40.00 |
| Copy on a compact disc we provide | R60.00 |
| Transcription of an audio record | R24.00 per A4 page |
| Copy of an audio record on a flash drive you provide, or a compact disc you provide | R40.00 |
| Copy of an audio record on a compact disc we provide | R60.00 |
| Transcription or copy of visual images | The cost quoted by the service provider we use |
| Search for and preparation of a record, for each hour or part of an hour after the first hour | R145.00, up to R435.00 in total |
| Deposit, if the search will take more than six hours | One third of the access fee |
| Postage, email or other electronic transfer | The actual cost |
We will tell you in writing what fees apply. We may keep a record until the fees are paid. If we refuse your request after you paid a deposit, we will repay it. If you disagree with a fee or deposit, you may complain to the Regulator.
9.4 Time limits and our decision
We will decide on your request and tell you within 30 days of receiving it with all the required details (section 56 of PAIA). If the request involves many records, needs a search in another place, or needs us to consult others, or if you agree, we may extend this once, by up to 30 more days. We will tell you in writing before the first 30 days end (section 57). If we do not decide in time, the law treats your request as refused (section 58).
If a record concerns someone else, we must first tell that person and give them 21 days to respond before we decide (section 71). We will let you know if this applies.
If we refuse your request, we will give you the reasons and the sections of PAIA we rely on, without revealing what the record contains.
9.5 If you are not satisfied
You may complain to the Regulator within 180 days of our decision (section 77A of PAIA), using the Regulator's PAIA complaint form (Form 5), sent to PAIAComplaints@inforegulator.org.za. After the complaint process, you may apply to court within 180 days (section 78).
